2.2 Service Packages

Our services are offered as fixed-price packages with clearly defined deliverables, timelines, and specifications. Custom solutions may be quoted separately based on specific requirements.

3. Orders and Acceptance

3.1 Order Process

Orders are placed through our website checkout system or by direct agreement. All orders are subject to acceptance by Delta Analyst Limited.

3.2 Order Confirmation

We will confirm your order via email within 24 hours. This confirmation constitutes acceptance of your order and forms a binding contract between you and Delta Analyst Limited.

3.3 Changes to Orders

Changes to confirmed orders may be possible but must be agreed upon in writing and may incur additional charges.

4. Pricing and Payment

4.1 Pricing

All prices are displayed in Kenyan Shillings (KES) and USD equivalents. Prices are fixed for the specified service packages and include all deliverables as described.

4.2 Payment Terms

  • Services under USD 10,000: Full payment required upfront
  • Services over USD 10,000: Milestone-based payments as agreed

4.3 Payment Methods

We accept payments via:

  • Credit/Debit cards through our payment processor

4.4 Late Payments

Late payments may result in project delays. Interest may be charged on overdue amounts at a rate of 2% per month.

5. Project Delivery

5.1 Delivery Timeline

Delivery timelines are provided as estimates and begin after:

  • Payment is received (or first installment for staged payments)
  • All required information and data access is provided
  • Project kick-off meeting is completed

5.2 Client Responsibilities

Timely delivery depends on the client providing:

  • Access to required data sources
  • Necessary approvals and feedback
  • Participation in scheduled meetings
  • Clarification of requirements when requested

5.3 Delivery Method

Services are delivered digitally through secure file sharing, cloud platforms, or direct system implementation as appropriate.

6. Intellectual Property

6.1 Client Ownership

Upon full payment, the client owns all deliverables created specifically for their project, including dashboards, models, and custom code.

6.2 Delta Analyst Property

We retain rights to:

  • Our proprietary methodologies and frameworks
  • Generic templates and tools used in service delivery
  • Knowledge and insights gained from the project (anonymized)

6.3 Third-Party Tools

Some projects may incorporate third-party tools or platforms. Clients are responsible for obtaining and maintaining necessary licenses for ongoing use.

7. Confidentiality and Data Protection

7.1 Confidentiality

We maintain strict confidentiality regarding all client data and business information. Our team members sign confidentiality agreements.

7.2 Data Security

We implement appropriate technical and organizational measures to protect client data, including:

  • Encrypted data transmission and storage
  • Access controls and audit trails
  • Secure deletion of data after project completion

7.3 Data Usage

Client data is used solely for service delivery. We do not share, sell, or use client data for any other purposes without explicit written consent.

8. Warranties and Guarantees

We guarantee that our services will:

  • Be delivered within the agreed timeline (subject to client cooperation)
  • Function as intended for the agreed purpose

8.2 Limitation of Warranties

Our services are provided “as is” beyond the explicit guarantees above. We do not warrant future performance of systems or data sources outside our control.

9. Limitation of Liability

9.1 Maximum Liability

Our total liability for any claim shall not exceed the total amount paid by the client for the specific service in question.

9.2 Excluded Damages

We shall not be liable for:

  • Indirect, consequential, or punitive damages
  • Loss of profits, revenue, or business opportunities
  • Data loss due to client system failures
  • Damages resulting from client’s use of deliverables contrary to our recommendations

10. Termination

10.1 Termination by Client

Clients may terminate services with written notice. Refunds will be calculated based on work completed and are subject to our refund policy.

10.2 Termination by Delta Analyst

We may terminate services if:

  • Payment is not received as agreed
  • Client fails to provide necessary cooperation or information
  • Client requests services that are illegal or unethical

11. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, or technical failures of third-party services.

12. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved through the courts of Kenya or through mutually agreed arbitration.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and take effect for new orders. Existing projects will continue under the terms agreed at the time of order.
